California Supreme Court Approves Organic Labeling Lawsuits

A recent ruling by the state Supreme Court of California allows consumers to file lawsuits “alleging products are falsely labeled ‘organic’.” This new ruling overturns a previous decision by a lower court. In the unanimous decision Associate Justice Kathryn Werdegar wrote “state lawsuits alleging intentional organic mislabeling promote, rather than hinder, Congress’s purposes and objectives…” The original lawsuit by consumer Michelle Quesada alleged that Herb Thyme Farms Inc. “mixed organic and non-organic herbs then falsely labeled the product ‘organic’.” The company countered by saying that they followed the rules and regulations set forth by the U.S. Department of Agriculture on labeling products “organic”, and allowing consumers to sue all manufacturers would “defeat the goal of a national organic foods marketplace.” With the Supreme Court of California’s decision in place, the lawsuit by Michelle Quesada will now move forward.
